What Happened to the Culprit, Jang Hayeong?

Jang Hayeong was found to be the primary culprit in the death of baby Jung-in and she was initially sentenced to life-in-prison. However, in the recent trial judgment, the Court announced in a shocking turn of events, that Jang Hayeong’s sentencing shall be reduced to merely 35 years in prison.

Although the prosecutor and the public kept on insisting — on the death penalty. The prosecution argued that  “this case is a crime against a 16-month-old child who had no ability in defending herself. The crime is heavy and against social norms.”

According to the Seoul High Court (in the initial hearing) stated that “there are no circumstantial indications that the accused thoroughly or systematically premeditated the crime,” and thus, life imprisonment would be warranted but not the death penalty.

Note that capital punishment or the death penalty is permissible in South Korea as per section 41 of the Criminal Law.

Shockingly, according to the Appellate Court, giving the culprit a sentence of life in prison is not justified and reasonable due to the lack of evidence.

According to a local news reporter, the court, however, viewed life imprisonment as too harsh a punishment, as Jang, 35, did not premediate or plan on murdering the young baby nor sought to conceal evidence of her actions.

The court also took into consideration that Jang had taken her daughter to the hospital on the day she died.

The judgment of the Appellate court has left everyone utterly stupefied and reasonably outraged. What do you think about the reduced sentencing?
